Detention Appeal Procedure

  1. Section 3.14 of the BS MOU states that “the owner or the operator of a ship will have the right of appeal against a detention decision to higher administrative Authority or to the court of competent jurisdiction, according to the law in each country. However, an appeal shall not cause the detention to be suspended”.
  2. Owners or operators should be advised to use official national procedure according the national jurisdiction of the country where the detention order was issued, if they wish to appeal against a detention order.

Report of the 2017 CIC on Saferty of Navigation-including ECDIS

From 1st September 2017 to 30th November 2017, the BS MOU carried out a Concentrated Inspection Campaign (CIC) on Safety of Navigation throughout the region. This campaign involved all member States of the BS MOU and was conducted in conjunction with the Tokyo MOU and Paris MOU and other MOUs. The campaign was conducted under the campaign coordination of the Bulgarian Maritime Administration. Paris and Tokyo MOUs guidelines and questionnaire were used.

During the campaign, a total of 983 inspections were carried out with the CIC questionnaire involving 983 individual ships. Of this quantity 59 ships were detained with 21 (35.6%) detentions being within the CIC scope. This means that in 21 cases the navigation systems are not meeting SOLAS requirements and had deficiencies, which were serious enough to detain the ship, resulting in a CIC-topic related detention rate of 2.14 per cent.

A total of 180 questionnaires had at least a non-compliance to a requirement, resulting 18.3 per cent of CIC inspections. The overall average per cent of non-conformities was 2.68.

Odesa, Ukraine – Representatives of the Port State Control Committee, the governing body under the Memorandum of Understanding on Port State Control in the Black Sea Region (BS MOU), met in Odesa, Ukraine, for the Nineteenth session from 17 to 19 April 2018.

The meeting was chaired by Mr. Hayri HASANDAYIOGLU – PSC Co-ordinator Maritime Administration of the Republic of Turkey.

Head of State Service of Ukraine for Transport Safety Maritime and River Transport made a welcome speech and officially declared the opening of the meeting. Captain Dmytro PETRENKO stressed the vital role of port State control for promotion of safer shipping and cleaner seas. He expressed that Ukraine praised the great achievement and success of the BS MOU during the years. He reassured the full cooperation and continuous contribution from Ukraine to the BS MOU.

Preliminary results of the CIC on Safety of Navigation Including ECDIS

From 1st September 2017 to 30th November 2017, the Memorandum of Understanding on Port State Control in the Black Sea Region (BS MOU) carried out a Concentrated Inspection Campaign (CIC) on Safety of Navigation including ECDIS aimed at checking the conformity of safety regulations for ships, the overall status of the vessel’s navigation safety, and the competency of crew involved in navigation operations. This campaign was conducted in conjunction with the Paris and Tokyo MOUs as well as other MOUs shows following preliminary results.

During the campaign, a total of 983 inspections were carried out with the CIC questionnaire involving 983 individual ships. Of this quantity 59 ships were detained with 21 (35.6%) detentions were being within the CIC scope. The overall detention rate per CIC inspection was 6.00% with a 2.14 % CIC-topic related detention rate per CIC inspection.

Notice to PSCOs No. 10 – GUIDANCE FOR PORT STATE CONTROL OFFICERS ON RELEVANT INSTRUMENTS

The purpose of this Notice is to: Raise awareness of PSCO’s that their possibilities to exercise port State control might be limited due to the fact that their State is not a Party to one or more of the relevant instruments; Give the status of relevant instruments as at 15 August 2017.
